Use of the Service

Messaging & consent

If you use the Service to send email or SMS, you are responsible for obtaining and honoring recipient consent and for complying with all applicable messaging laws and carrier requirements (including TCPA and CTIA guidelines). You must promptly honor opt-out requests (e.g., STOP) and must not send prohibited content. See our Privacy Policy for how messaging data is handled.

Customer data

You retain ownership of the data you provide. You grant us the rights needed to operate the Service on your behalf. We process customer data as described in the Privacy Policy.

Availability & changes

We may modify or discontinue features and may update these Terms; material changes will be reflected by the "last updated" date. Continued use constitutes acceptance.

Disclaimers & liability

The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Pensago LLC is not liable for indirect or consequential damages arising from use of the Service.

Governing law

These Terms are governed by the laws of the State of Arkansas, without regard to conflict of law rules.
